Winner’s Bike Liability Disclaimer

By accepting a prize from MTB Giveaways Australia, the winner acknowledges and agrees to the following:

Once the prize bike has been received by the winner—whether in person, by courier, or via a nominated third party—MTB Giveaways Australia and its associated entities, partners, and suppliers accept no responsibility or liability whatsoever for any damage, fault, defect, loss, or injury arising from:

• the unpacking, assembly, or installation of the bike;

• any mechanical adjustments or component setup undertaken by the winner or a third party; and/or

• the subsequent use, operation, or riding of the bike.

All bikes are inspected, tested, and dispatched in good faith and in full working order at the time of handover or shipment. It is the sole responsibility of the winner to ensure that the bike is correctly assembled, maintained, and safe for use by engaging a qualified bicycle mechanic prior to riding.

MTB Giveaways Australia provides no warranty or guarantee—express or implied—beyond that provided by the original manufacturer of the bike or its components. By accepting the prize, the winner releases MTB Giveaways Australia from any and all claims, liabilities, or actions arising from damage, injury, or loss sustained following receipt of the prize.

PRIZE FULFILMENT, BICYCLE SIZING, DELIVERY, ASSEMBLY & LIABILITY TERMS AND CONDITIONS

THIRD-PARTY SUPPLIERS AND PRIZE FULFILMENT

MTB Giveaways Australia sources prizes through independent manufacturers, bicycle retailers, distributors, bicycle shops and other third-party suppliers.

Prizes may be dispatched directly from these suppliers to winners. MTB Giveaways Australia does not necessarily physically receive, inspect, assemble or handle bicycles before delivery.

While reasonable care is taken when ordering and arranging prizes, MTB Giveaways Australia cannot guarantee that third-party suppliers will be free from administrative, manufacturing, dispatch or fulfilment errors.

Any issues arising from third-party fulfilment will be assessed individually, subject to the relevant promotional terms and applicable Australian law.

 

BICYCLE FRAME SIZING AND SPECIFICATIONS

Bicycle frame sizes, component specifications, colours and configurations may vary between manufacturers, models and production batches.

Winners acknowledge that bicycle sizing recommendations can differ between manufacturers and that a particular frame size may not necessarily provide their preferred riding position or fit.

Where a choice of frame size is offered, availability is subject to the manufacturer and supplier. Any limitations or substitutions will be communicated to the winner where applicable.

Winners are responsible for considering their personal sizing preferences and are encouraged to seek professional bicycle fitting advice before selecting a frame size.

MTB Giveaways Australia relies on third-party suppliers to provide the correct frame size and components as ordered.

Where a bicycle differs materially from the confirmed prize specifications, the discrepancy will be assessed in accordance with the applicable promotional terms and Australian law.

 

MANDATORY 24-HOUR BICYCLE INSPECTION, REPORTING & ASSEMBLY REQUIREMENTS

All bicycle prize winners MUST thoroughly inspect their bicycle immediately upon delivery, within 24 hours of receipt, and BEFORE any assembly, modification, adjustment or use takes place.

Any incorrect frame size, missing component, visible damage, specification discrepancy, shipping damage or other identifiable issue MUST be reported to MTB Giveaways Australia in writing within 24 hours of delivery and BEFORE assembly commences.

Mandatory photographic evidence

The following evidence MUST accompany the notification within the 24-hour reporting period:

• Clear photographs showing the reported damage, error or discrepancy.

• Photographs of the bicycle frame, including the frame size label and serial number.

• Photographs of any missing, damaged or incorrectly supplied components, where applicable.

• Photographs of the original packaging and any visible shipping damage, where relevant.

• A written explanation identifying the issue and the date of delivery.

IMPORTANT: WINNERS MUST NOT ASSEMBLE, MODIFY, ADJUST OR USE A BICYCLE AFTER IDENTIFYING ANY SUSPECTED DAMAGE, INCORRECT SIZING OR OTHER DISCREPANCY WITHOUT FIRST NOTIFYING MTB GIVEAWAYS AUSTRALIA.

All original packaging, labels, components and relevant documentation must be retained until the issue has been reviewed.

These inspection and reporting requirements are necessary to allow MTB Giveaways Australia to investigate issues with the relevant bicycle retailer, manufacturer, distributor or freight provider before the condition of the bicycle changes.

Failure to comply with the inspection requirements

Where a winner:

• Fails to report an identifiable issue within 24 hours of delivery;

• Fails to provide the required photographic evidence;

• Commences assembly before reporting an identified discrepancy;

• Modifies, adjusts or uses the bicycle after discovering an issue; or

• Discards relevant packaging or components before an investigation can be completed;

MTB Giveaways Australia reserves the right to decline discretionary returns, exchanges, replacement components, additional purchases, workshop labour reimbursements and other voluntary assistance.

MTB Giveaways Australia will not voluntarily cover expenses arising from assembly, modification, repairs or replacement work undertaken without its prior written authorisation.

Any discretionary replacement or exchange is subject to verification of the reported issue, the condition of the bicycle and the availability of suitable replacement stock.

Claims involving damage occurring after delivery, incorrect assembly, misuse, unauthorised modifications or normal wear and tear are excluded from voluntary replacement assistance.

These conditions operate to the maximum extent permitted by Australian law and do not exclude any rights or remedies that cannot legally be excluded.

 

BICYCLE ASSEMBLY AND WORKSHOP COSTS

Unless expressly included in the advertised prize, professional bicycle assembly, fitting, customisation and associated workshop labour are not included.

Winners are responsible for arranging and paying for any independently commissioned assembly or setup services.

MTB Giveaways Australia does not ordinarily reimburse expenses relating to:

• Initial bicycle assembly or setup.

• Handlebar cutting, adjustment or replacement.

• Suspension setup and tuning.

• Dropper post replacement or modification.

• Personalised bicycle fitting.

• Component upgrades or customisation.

• Labour associated with voluntary modifications.

• Disassembly and reassembly undertaken without prior written authorisation.

Any additional costs associated with a defective or incorrectly supplied prize will be assessed separately where required by applicable law.

 

ASSEMBLY, MODIFICATIONS AND REPLACEMENT REQUESTS

Winners must complete the inspection process outlined in the mandatory inspection requirements before commencing assembly or modification.

Once a bicycle has been assembled, used or modified, certain discretionary exchanges and supplier returns may no longer be available.

MTB Giveaways Australia does not guarantee that a manufacturer, distributor or bicycle retailer will accept the return of a bicycle or component that has been assembled, altered, damaged or used.

Any discretionary exchange may require the original bicycle or component to be returned for inspection in its original condition.

MTB Giveaways Australia is not responsible for damage caused by incorrect assembly, unauthorised modifications, improper installation or work performed by independent third parties, except where responsibility cannot legally be excluded.

Assembly or modification does not automatically extinguish any non-excludable statutory rights.

 

SHIPPING, DELIVERY AND TRANSIT DAMAGE

Prizes may be transported by independent freight companies, couriers or third-party delivery providers.

Winners MUST inspect the external packaging and bicycle for visible damage within 24 hours of delivery and report any identifiable shipping damage in accordance with the mandatory inspection requirements.

Photographic evidence of the packaging and affected components must be provided within the reporting period wherever the damage is reasonably identifiable.

Winners must retain the original packaging until any reported shipping issue has been investigated.

MTB Giveaways Australia does not accept responsibility for damage caused by the winner's handling, storage, transportation, misuse or modifications after delivery.

Responsibility for damage occurring before delivery, including damage caused by third-party carriers, will be determined in accordance with applicable law and the relevant delivery arrangements.

 

MAINTENANCE, SERVICING, REPAIRS AND ONGOING EXPENSES

Unless expressly stated otherwise, MTB Giveaways Australia does not provide ongoing bicycle maintenance, servicing or repair services as part of any prize.

Following delivery, winners are ordinarily responsible for all routine ownership and operating expenses, including:

• Scheduled bicycle servicing and maintenance.

• Replacement tyres, brake pads, chains and drivetrain components.

• Suspension servicing and adjustments.

• General wear and tear.

• Bicycle fitting and setup adjustments.

• Damage caused by crashes, accidents or misuse.

• Damage caused by improper maintenance or unauthorised modifications.

• Optional component upgrades and accessories.

• Ongoing operating and ownership expenses.

MTB Giveaways Australia does not ordinarily reimburse these expenses.

This provision does not exclude any applicable rights relating to defects, failures or other matters for which a remedy is required by law.

 

MANUFACTURER WARRANTIES

Manufacturer warranties, where applicable, are subject to the relevant manufacturer's published terms, eligibility requirements and claim procedures.

Certain manufacturers may impose restrictions relating to warranty registration, transferability, original purchase documentation or subsequent ownership.

Winners may be required to contact the relevant manufacturer or authorised retailer regarding manufacturer warranty enquiries.

MTB Giveaways Australia does not provide an additional manufacturer warranty unless expressly confirmed in writing.

Nothing in this section excludes any rights or remedies available under applicable Australian law.

 

PRIZE AVAILABILITY AND SUBSTITUTIONS

Certain prizes, particularly limited-edition bicycles, may have restricted production numbers, limited stock availability or extended manufacturer lead times.

MTB Giveaways Australia cannot guarantee the immediate availability of replacement frames, components or identical products where stock has been discontinued, restricted or exhausted.

Any proposed replacement or substitution will be assessed against the original prize description, relevant promotional terms, applicable permit conditions and Australian law.

Material prize substitutions may require the winner's agreement and any necessary regulatory approval.

 

ADDITIONAL EXPENSES AND UNAUTHORISED COMMITMENTS

Winners must obtain written authorisation from MTB Giveaways Australia before incurring expenses for which they intend to seek reimbursement.

MTB Giveaways Australia does not ordinarily accept responsibility for independently incurred expenses without prior written agreement, including:

• Third-party workshop labour.

• Bicycle assembly and disassembly.

• Replacement components.

• Frame modifications or exchanges.

• Shipping arranged independently by the winner.

• Voluntary repairs, upgrades or customisation.

• Additional transport or storage expenses.

This requirement does not prevent a winner from exercising any statutory entitlement to compensation or reimbursement.

 

LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, MTB Giveaways Australia excludes liability for indirect or consequential losses arising from circumstances outside its reasonable control, except where such liability cannot lawfully be excluded.

MTB Giveaways Australia is not responsible for damage, loss or expenses arising solely from a winner's misuse, negligent handling, incorrect assembly, unauthorised modifications or failure to maintain the bicycle appropriately.

Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, statutory remedy, promotional obligation or other right that cannot lawfully be excluded, restricted or modified.

 

REPORTING PRIZE ISSUES

All identifiable bicycle discrepancies and visible damage must be reported in accordance with the mandatory 24-hour inspection requirements.

Reports must be submitted in writing with the required photographic evidence.

MTB Giveaways Australia may request further documentation, photographs, serial numbers or an independent inspection where reasonably necessary to investigate a reported issue.

Winners must not authorise repairs, modifications or replacement purchases on behalf of MTB Giveaways Australia without prior written approval.

Each matter will be assessed according to the circumstances, the advertised prize specifications, the relevant promotional terms and applicable law.

 

ACCEPTANCE OF PRIZE CONDITIONS

By accepting a bicycle prize, winners acknowledge that:

• Bicycle ownership may involve ongoing maintenance, servicing, repairs and operating expenses.

• Assembly and workshop labour are not included unless expressly advertised.

• Frame sizing and personal bicycle fit should be carefully considered.

• Bicycles must be inspected within 24 hours of delivery and before assembly.

• Identifiable discrepancies must be reported promptly with photographic evidence.

• Unauthorised modifications or repairs may affect discretionary return and replacement options.

• MTB Giveaways Australia does not ordinarily reimburse independently incurred expenses without prior written agreement.

Acceptance of a prize does not constitute a waiver of any non-excludable statutory rights or remedies.

We reserve the right to add, change, modify, suspend, or discontinue any part of the Services at our sole discretion without notice or liability. Your continued use of the Site and Services, including access to new features or partner offers, remains subject to these Terms and Conditions. MTB Giveaways may also impose limits on any part of the Service or restrict access at its discretion.

2. Sale of Goods and Services

2.1 Orders and Payments

• Orders placed through our website constitute a legally binding contract between the purchaser and MTBGA.

• Payment must be made in full at the time of purchase via the available payment methods.

• Orders cannot be canceled once processed, except as required by Australian Consumer Law.

• Prices are subject to change without notice and include Goods and Services Tax (GST) where applicable.

2.2 Shipping and Delivery

• Customers must provide accurate shipping details. MTBGA is not responsible for incorrect addresses or failed deliveries due to incorrect information provided by the customer.

• Shipping and handling fees are calculated at checkout and are the responsibility of the customer.

• Risk of loss or damage transfers to the customer once goods are dispatched to the shipping provider.

• MTBGA is not liable for delays in delivery caused by postal services or external factors beyond our control.

2.3 Returns, Refunds, and Consumer Rights

• Refunds or exchanges are available for faulty, defective, or misrepresented goods in accordance with Australian Consumer Law.

• No refunds are issued for change of mind purchases.

• Refund requests must be submitted to MTBGA’s customer service team within a reasonable timeframe.

• Refunds will be processed to the original payment method within 7-14 business days.

• All goods must be returned in their original condition unless otherwise instructed.

3. Events

• Tickets purchased for events hosted by MTBGA are non-refundable unless the event is canceled by MTBGA.

• If an event is canceled, attendees will be offered a full refund or the option to reschedule.

• MTBGA reserves the right to change event details such as venue, date, and time due to unforeseen circumstances.

• Attendees participate in events at their own risk. MTBGA is not liable for injuries, losses, or damages incurred during an event.

• By attending an event, participants consent to photography and videography, which may be used for promotional purposes.

4. Trade Promotions, Giveaways & Raffles

4.1 Compliance and Eligibility

• All trade promotions conducted by MTBGA comply with the relevant gaming and trade promotion laws of each Australian state and territory.

• Residents of South Australia and Northern Territory are not eligible to participate in trade promotions unless MTBGA has secured the necessary permits.

• MTBGA obtains all required permits before launching any trade promotion, in compliance with:

  • WA – Gaming and Wagering Commission Act

  • NSW – Community Gaming and Lotteries Regulations

  • VIC – Gambling Regulation Act

  • TAS, SA, NT, ACT – Respective gaming regulations

Regardless of the fact that MTB GIVEAWAYS AUSTRALIA is a membership club, the company will always secure necessary permits to cover all areas should it need to. 

4.2 Terms of Entry

• Promotions must include a clear description of the prize(s), eligibility criteria, and method of entry.

• The method for determining the winner must be clearly stated and comply with legal requirements.

• If a promotion is conducted via electronic, audio, or visual media, the full Terms & Conditions must be submitted to the Gaming and Wagering Commission (GWC) of WA before commencement.

• Once a promotion has started, its Terms & Conditions cannot be amended, and it cannot be canceled or withdrawn without prior written approval from the GWC.

• Promotion records must be retained for 12 months and made available for inspection by an authorised officer or police officer upon request.

4.3 Draws and Prize Claims

• All draws are conducted fairly and transparently using an approved method.

• Winners are notified via the contact details provided at the time of entry.

• Unclaimed prizes will be handled in accordance with regulatory requirements.

• If a draw cannot be conducted as planned due to unforeseen circumstances, MTBGA reserves the right to reschedule the draw, subject to regulatory approvals.

• If practicable, prize draws should be conducted publicly. If a public draw is not possible, audit records confirming the draw must be made available to an authorised officer upon request.

5. Legal Compliance & Liability

• These Terms & Conditions are governed by the laws of Victoria, Australia, unless otherwise required by state-specific regulations.

• MTBGA is not liable for any indirect or consequential losses, including but not limited to financial opportunities or third-party claims.

• Customers and participants indemnify MTBGA against any claims, damages, or liabilities arising from their participation in giveaways, purchases, or events.

• MTBGA makes no guarantees regarding the availability or functionality of its website and services and reserves the right to modify or discontinue any aspect of the service at any time.

6. Privacy Policy

• MTBGA respects customer privacy and complies with Australian privacy laws.

• Personal information collected during transactions or promotions is used solely for order processing, communication, and legal compliance.

• We do not sell, rent, or distribute personal data to third parties, except as required by law.
