2. How to Enter the Lottery

  • Entry Method:
    To enter the lottery, you must purchase either a membership or a discount package as displayed on our website.

  • Free Entries:
    Upon purchase, you will receive free lottery entries based on the specific membership or package acquired. The number of free entries granted will be clearly indicated in the description of the package or membership.

 

3. Eligibility Criteria

  • Age Requirement:
    You must be 18 years of age or older to purchase a ticket or membership.

  • Residency Restrictions:
    Residents of South Australia are excluded from participating in ticketed trade promotions unless MTB Giveaways Australia (MTBGA) has secured the necessary permits. For complete details on eligibility and participation, please refer to our official Terms and Conditions.

 

4. Prize Details
The sole prize for this lottery is a Santa Cruz Megatower Mountain Bike, with a purchase value of $10,000.

 

5. Lottery Entry Period

  • Start Date: 22/03/2025

  • Closing Date: 03/04/2025
    Please note: The lottery entry dates are provided subject to the activation of necessary permits and may be adjusted accordingly. In the event of any discrepancies, updated dates will be published on our website.

 

6. Draw Details

7. Winner Notification

  • The winner will be announced live on Instagram.

  • All entrants will receive an email notification on the following morning, and the winning details will also be published on our website.

  • Redraw Conditions:
    Should the initial winner fail to claim their prize within three months of the draw date, a redraw will be conducted. Details of the date, time, and location for the redraw will be communicated accordingly.

Welcome to MTB Giveaways Australia (MTBGA). By accessing or using our website (mtbgiveawaysaustralia.com.au) and services, you agree to be bound by these Terms & Conditions. Please read them carefully before making a purchase, entering a promotion, or participating in any activity on our platform.

1. General Terms

  • These Terms & Conditions outline the terms governing the sale of goods, services, trade promotions, raffles, and events conducted by MTBGA.

  • By placing an order, purchasing tickets, or entering a giveaway, you acknowledge that you have read, understood, and agreed to be bound by these Terms.

  • MTBGA reserves the right to modify these Terms at any time without prior notice, except where regulatory approvals are required. Continued use of our services after any changes constitutes acceptance of the revised Terms.

2. Sale of Goods and Services

2.1 Orders and Payments

  • Orders placed through our website constitute a legally binding contract between the purchaser and MTBGA.

  • Payment must be made in full at the time of purchase via the available payment methods.

  • Orders cannot be canceled once processed, except as required by Australian Consumer Law.

  • Prices are subject to change without notice and include Goods and Services Tax (GST) where applicable.

2.2 Shipping and Delivery

  • Customers must provide accurate shipping details. MTBGA is not responsible for incorrect addresses or failed deliveries due to incorrect information provided by the customer.

  • Shipping and handling fees are calculated at checkout and are the responsibility of the customer.

  • Risk of loss or damage transfers to the customer once goods are dispatched to the shipping provider.

  • MTBGA is not liable for delays in delivery caused by postal services or external factors beyond our control.

2.3 Returns, Refunds, and Consumer Rights

  • Refunds or exchanges are available for faulty, defective, or misrepresented goods in accordance with Australian Consumer Law.

  • No refunds are issued for change of mind purchases.

  • Refund requests must be submitted to MTBGA’s customer service team within a reasonable timeframe.

  • Refunds will be processed to the original payment method within 7-14 business days.

  • All goods must be returned in their original condition unless otherwise instructed.

3. Events

  • Tickets purchased for events hosted by MTBGA are non-refundable unless the event is canceled by MTBGA.

  • If an event is canceled, attendees will be offered a full refund or the option to reschedule.

  • MTBGA reserves the right to change event details such as venue, date, and time due to unforeseen circumstances.

  • Attendees participate in events at their own risk. MTBGA is not liable for injuries, losses, or damages incurred during an event.

  • By attending an event, participants consent to photography and videography, which may be used for promotional purposes.

4. Trade Promotions, Giveaways & Raffles

4.1 Compliance and Eligibility

  • All trade promotions, giveaways, and raffles conducted by MTBGA comply with the relevant gaming and trade promotion laws of each Australian state and territory.

  • Residents of South Australia and Northern Territory are not eligible to participate in ticketed trade promotions unless MTBGA has secured the necessary permits.

  • MTBGA obtains all required permits before launching any trade promotion, in compliance with:

    • WA – Gaming and Wagering Commission Act

    • NSW – Community Gaming and Lotteries Regulations

    • VIC – Gambling Regulation Act

    • QLD – Charitable and Non-Profit Gaming Act

    • TAS, SA, NT, ACT – Respective gaming regulations

4.2 Terms of Entry

  • Promotions must include a clear description of the prize(s), eligibility criteria, and method of entry.

  • The method for determining the winner must be clearly stated and comply with legal requirements.

  • If a promotion is conducted via electronic, audio, or visual media, the full Terms & Conditions must be submitted to the Gaming and Wagering Commission (GWC) of WA before commencement.

  • Once a promotion has started, its Terms & Conditions cannot be amended, and it cannot be canceled or withdrawn without prior written approval from the GWC.

  • Promotion records must be retained for 12 months and made available for inspection by an authorised officer or police officer upon request.

4.3 Draws and Prize Claims

  • All draws are conducted fairly and transparently using an approved method.

  • Winners are notified via the contact details provided at the time of entry.

  • Unclaimed prizes will be handled in accordance with regulatory requirements.

  • If a draw cannot be conducted as planned due to unforeseen circumstances, MTBGA reserves the right to reschedule the draw, subject to regulatory approvals.

  • If practicable, prize draws should be conducted publicly. If a public draw is not possible, audit records confirming the draw must be made available to an authorised officer upon request.

5. Legal Compliance & Liability

  • These Terms & Conditions are governed by the laws of Victoria, Australia, unless otherwise required by state-specific regulations.

  • MTBGA is not liable for any indirect or consequential losses, including but not limited to financial opportunities or third-party claims.

  • Customers and participants indemnify MTBGA against any claims, damages, or liabilities arising from their participation in giveaways, purchases, or events.

  • MTBGA makes no guarantees regarding the availability or functionality of its website and services and reserves the right to modify or discontinue any aspect of the service at any time.

6. Privacy Policy

  • MTBGA respects customer privacy and complies with Australian privacy laws.

  • Personal information collected during transactions or promotions is used solely for order processing, communication, and legal compliance.

  • We do not sell, rent, or distribute personal data to third parties, except as required by law.
